1) Intellectual Property Rights Notice:

At MISH, we take our creative work and brand identity very seriously. All intellectual property associated with our brand is legally protected and must be respected in accordance with national and international laws.

a) Ownership of Intellectual Property:

All content on the website www.thehouseofmish.com including but not limited to:

-Brand name 'MISH' and its logo.

-Product designs, silhouettes, and embellishment patterns.

-Photographs, graphics, videos, and promotional material.

-Website layout, text, typography and visual assets.

-Product names and descriptions.

-Social media content. (Instagram, etc)

-Packaging and custom design elements.

is the exclusive property of MISH and is protected under the Indian Copyright Act, the Trademarks Act, and applicable international intellectual property laws and treaties.

b) Trademarks:

-The MISH name, stylized logo, product names, taglines and slogans are either registered trademarks or marks pending registration in India and/or other jurisdictions and may not be used in connection with any product or service that is not offered by us.

-Any use that could cause confusion among customers or discredit MISH's reputation is strictly prohibited. Any unauthorized use, reproduction, distribution, or modification of these trademarks without prior written consent constitutes trademark infringement and may result in civil and/or criminal liability under applicable laws.

c) Copyright And Design Rights:

All original designs, hand embroidery patterns, and aesthetic compositions of our footwear are copyrighted and/or protected as design rights.

Our products are artisanal and unique; any duplication, reproduction, or close imitation- whether for personal, commercial, or retail use- constitutes infringement and will be legally pursued.

d) Restrictions on Use:

You may not, without our prior written permission:

-Copy, reproduce, modify, republish, upload, post, transmit, or distribute any material from our website or social media platforms.

-Use our imagery, logo, or product design to create counterfeit or inspired versions.

-Claim ownership or authorship over MISH'S content or products.

-Use our brand name, content, or media to imply any endorsement, affiliation, or partnership.

e) Legal Action for Infringement:

We reserve the right to initiate legal proceedings against any individual or business entity found to be infringing upon MISH's intellectual property rights. This includes, but not limited to:

-Injunctions and cease-and-desist orders.

-Claims for damages and loss of reputation.

f) Acknowledgement:

By using our website or social media content, you acknowledge and agree to abide by the above terms relating to intellectual property.

g) Governing Law and Jurisdiction: 

This policy shall be governed by and constructed in accordance with the laws of India. Any disputes arising out of or in connection with the enforcement or violation of MISH's intellectual property rights shall be subject to the exclusive jurisdiction of the courts located in Mumbai, Maharashtra.

 

2) Warranty Disclaimer:

All MISH products are handmade with the highest attention to craftsmanship and quality. However, as our footwear is artisanal in nature:

-We do not provide any warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, durability, or non-infringement.

-Slight variations in embroidery, colour, or finishing- attributable to the handcrafted process- do not constitute defects.

-Please handle the products with care and store it in the dustbag provided for long term preservation. Ensure that the footwear is stored with silica gel provided to protect it from moisture and humidity. Damage caused due to improper use, exposure to harsh conditions, or lack of maintenance will not be covered under any warranty or replacement request.

 

3) Limitation of Liability:

To the fullest extent permitted by applicable law, MISH shall not be held liable for:

-Any indirect, incidental, special, punitive, or consequential damages.

-Any loss of profits, revenue, business opportunities, or data, even if advised of the possibility of such damages.

-Any damages or losses arising out of or related to the use or inability to use our products or website, or from any acts, omissions, or failures of third-party service providers (including shipping or payment gateways)

-Our total aggregate liability in any matter arising from or related to the site or our products is strictly limited to the amount paid by you for the product(s) in question.

 

4) Indemnification:

You agree to indemnify, defend, and hold harmless MISH, its founder(s), employees, affiliates, vendors, and licensors from any and all claims, liabilities, damages, losses, costs, expenses or fees that may rise from:

-Your use or misuse of our website or products,

-Your violation of these Terms and Conditions,

-Any infringement by you of third-party rights, including intellectual property or privacy rights.

 

5) Force Majeure:

We shall not be held for any failure or delay in performance caused by acts beyond our reasonable control, including but not limited to natural disasters, pandemics, strikes, lockdowns, government actions or interruptions in internet services or transportation.
